Acting Judge President Hosea Angula has ordered the suspension of a Windhoek-based lawyer, Richard Traugott Diethelm Mueller after the Law Society of Namibia filed an urgent court application in a case of suspected embezzlement of funds to the tune of N$1.5 million.
Mueller stands accused of failing to pay monies owed to Sun Karros Lifestyle.
Prior to the filing of the urgent court application, the lawyer wrote to the Registrar General informing of his decision to give up his carrier as a lawyer even though he was aware the urgent court application hearing was coming.
Yesterday, Uno Katjipukua appeared alone before the Acting Judge President, representing LSN where she said Mueller’s letter of resignation did not solve questions around the fate of his firm and trust account.
Acting Judge President Angula said that Mueller’s resignation was an attempt at avoiding the smashing of his name via a court order.
Judge Angula said Mueller had not followed the right procedure.
“You can’t just write a letter,” said the Judge adding that Mueller was appointed by an order of the court and he thus had to be removed by the same procedure.
Mueller is supposed to apply for removal, said the Judge adding that the public interest in the case was at stake.
Katjipukua also submitted that Mueller’s books have to be taken over, while the LSN has to be appointed the curator to liquidate his company.
